If you are not receiving the court mandated child or spousal support you settled on during your divorce, or your spouse has not followed another aspect of your divorce decree, you can file a contempt action against your spouse. Being found in contempt of court is a serious matter, and could even lead to jail time, thus it is not a matter to be taken lightly.
Furthermore, inability to pay is a defense only whether the contemnor demonstrates fully that he or she has exhausted all resources and assets and is still unable to secure the funds to comply with the court order. Even then, the court will be interested to hear why no modification action was filed.
That being said, filing a contempt action can be costly, and should therefore be done in cases where no other options are present. Your attorney can help you decide whether your case would benefit from a contempt action, or whether it would be best to take an alternate route to protect your rights, such as modification or a mediation attempt.
If your spouse has not held up their end of the court order consistently, you would be best served by first gathering all of the necessary documentation you need to prove this and then consulting with your family law attorney.
Conversely, if you have been charged with contempt, you should also gather all of your records and documents and immediately consult with an attorney to protect your rights. If you are found in contempt of court, you could be ordered to pay back the support you owe in retrospect, and could even be ordered to pay the attorney’s fees of the other party.
